Drawn For You Studio

Terms of Service

Effective date: July 1, 2026

These Terms of Service ("Terms") govern your use of the website at drawnforyoustudio.com and your purchase of custom goods and services from Drawn For You Studio ("the Studio," "we," "us," or "our"). By accessing our website, requesting a quote, placing an order, or submitting payment, you ("the Client," "you") acknowledge that you have read, understood, and agree to be bound by these Terms.

1.About Our Work

The Studio creates bespoke, hand-drawn custom scarves, display envelopes, and related keepsakes. Every piece is designed individually and produced to order in collaboration with the Client. Because our products are handmade and made-to-order, minor variations in color, hand-finishing, and appearance are an inherent and expected characteristic of custom work, and are not considered defects. Colors shown on a screen or in a proof may differ from the final printed fabric due to the nature of digital displays and textile printing.

2.Quotes & Pricing

Prices are quoted per piece and are tiered by quantity; the per-unit price may change if the final quantity, size, fabric, or specifications change. A quote is an estimate and is not binding until confirmed in a signed agreement (see Section 3). Shipping is not included in quoted or contract pricing and is billed at cost. All pricing is in U.S. dollars.

3.Orders & the Governing Agreement

An order is confirmed only upon the Client's execution of the Studio's project agreement ("the Contract") and payment of the required deposit. The Contract sets out the specific scope, specifications, quantities, pricing, and schedule for the Client's order. In the event of any conflict between these Terms and a signed Contract, the signed Contract controls with respect to that order.

4.Deposits

A deposit is required to reserve the Client's place in the Studio's design calendar and to begin work. This deposit secures a limited production slot that the Studio declines to offer to other clients.

Once design work has begun, the deposit is fully earned and is non-refundable. This reflects the creative time invested and the reserved placement in the Studio's calendar, which cannot be recovered. If the Client cancels before any design work has commenced, the Studio may, in its sole discretion, refund all or a portion of the deposit.

5.Payment Terms

Unless the Contract states otherwise, payment is made on a schedule consisting of a deposit due at signing, a payment at design completion, and a final payment due before the order ships. Orders will not be shipped until payment is received in full. We accept payment by credit or debit card through our payment processor; card payments may include a processing surcharge, which will be shown before payment. Work and shipment may be paused on any order with an overdue balance.

6.The Design & Proofing Process

Design is a collaborative process, and a reasonable number of revision rounds is included as a normal part of creating your piece. To keep the process productive and on schedule, the Client agrees to participate in good faith by:

Revisions that are reasonable, timely, and consistent with the direction previously approved are included. Requests that are excessive, that repeatedly reopen elements already settled, that materially depart from the approved direction, or that are submitted in a fragmented manner that disrupts the schedule may, at the Studio's discretion, require additional time and a supplemental fee, which will be quoted in advance for the Client's approval. Production does not begin until the Client has approved the final proof. The Client is responsible for carefully reviewing each proof for accuracy, including spelling, names, dates, and all details; the Studio is not responsible for errors in content approved by the Client. Changes requested after final approval may incur additional fees and will extend the timeline.

7.Production & Timelines

Items are made to order, and certain materials (including silk) are printed overseas and must clear customs. Stated turnaround times and dates are good-faith estimates, not guarantees, and depend on the Client meeting all approval and payment deadlines. Delays caused by the Client's late approvals, late payments, or late delivery of requested information extend the schedule accordingly. The Studio places each project in its calendar by event date and works backward from the deadline; timely collaboration is essential to meeting an event date.

8.Shipping & Risk of Loss

Orders are shipped at cost to the address provided by the Client, who is responsible for its accuracy. Title and risk of loss pass to the Client upon the Studio's delivery of the order to the shipping carrier. The Studio is not responsible for carrier delays, loss, or damage occurring in transit, or for any customs duties, taxes, or import fees, which are the Client's responsibility.

Although the Studio builds buffer time into its schedule to reduce risk, delivery is outside the Studio's control once an order has been handed to the carrier. The Studio is not responsible if a shipping carrier fails to meet its delivery commitment and the Client's event date is missed as a result, including where the delay or failure to deliver arises from the carrier's own error or neglect. A missed, delayed, or failed delivery by the carrier is not grounds for a refund, discount, or other liability on the part of the Studio.

9.Inspection, Defects & Damage

Each piece is individually inspected for quality before it leaves the Studio and is confirmed to be in excellent condition at that time. Because of this inspection, the Studio is not responsible for damage, soiling, staining, or wear that occurs after the item has left the Studio's possession, including damage arising from handling, storage, use, neglect, or the shipping carrier.

The Client is responsible for inspecting the order upon delivery. In the unlikely event of a genuine manufacturing defect present at the time of delivery, the Client must notify the Studio in writing, with clear photographs, upon delivery. Defects reported after delivery are presumed to have arisen after the items left the Studio's possession and are not covered. For a defect reported upon delivery, the Studio's sole obligation, and the Client's exclusive remedy, is—at the Studio's discretion—the repair or reproduction of the affected item(s). Custom, made-to-order items are not eligible for return, exchange, or refund.

10.Cancellations & Refunds

Because our products are custom and made to order, deposits are non-refundable once design work has begun (Section 4), and no refunds are available once production has begun. Amounts paid for completed or in-progress custom work are non-refundable. Nothing in this Section limits the defect remedy described in Section 9.

11.Intellectual Property

All artwork, illustrations, designs, and concepts created by the Studio remain the exclusive property of the Studio, including the copyright therein. The Client receives the finished physical goods and the right to use them for their personal, non-commercial event; the Client does not acquire ownership of the underlying artwork or the right to reproduce it. The Studio may photograph and display finished work in its portfolio and marketing; a Client who prefers their pieces not be shared may request this in writing. The Client represents that any logos, images, text, or other materials they provide do not infringe the rights of others, and grants the Studio permission to use those materials to fulfill the order.

12.Client Responsibilities

The Client agrees to provide accurate and complete information, to review and approve proofs and provide feedback in a timely and consolidated manner, to make payments when due, and to ensure they hold the necessary rights to any content they submit.

13.Limitation of Liability

To the fullest extent permitted by law, the Studio's total liability arising out of or relating to any order or these Terms shall not exceed the total amount paid by the Client for that order. The Studio shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits or damages arising from carrier delays, events outside our reasonable control, or the Client's reliance on an estimated timeline.

14.Indemnification

The Client agrees to indemnify, defend, and hold harmless the Studio and its owner from and against any third-party claims, demands, damages, losses, liabilities, and reasonable expenses (including reasonable attorneys' fees) arising out of or relating to: (a) any logos, images, text, names, artwork, or other materials the Client provides to the Studio, including any claim that such materials infringe or misappropriate the intellectual property, privacy, publicity, or other rights of a third party; (b) the Client's breach of these Terms or of any representation the Client makes in them; or (c) the Client's use of the finished goods. This obligation survives completion of the order and the termination of these Terms.

15.Privacy

Information you provide is used only to respond to inquiries, fulfill orders, and communicate with you about your project. We do not sell your personal information. Payment card details are handled by our payment processor and are not stored by the Studio. See our Privacy Policy for details.

16.Governing Law & Disputes

These Terms and any order are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The parties agree to first attempt to resolve any dispute informally and in good faith. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Florida, and the parties consent to the jurisdiction of those courts.

17.Changes to These Terms

The Studio may update these Terms from time to time. The version in effect at the time of your order governs that order. Material changes will be posted on this page with an updated effective date.

18.Entire Agreement & Severability

These Terms, together with any signed Contract, constitute the entire agreement between the Client and the Studio regarding its subject matter. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
